If you’ve declared bankruptcy previously, and you need to file bankruptcy again, there are several limitations. First of all, in a Chapter 7, which is a liquidating chapter, you can only file a Chapter 7 once every eight years so if you filed today, you have to wait eight years and one day before you can file again. In Chapter 13 bankruptcy, the rule is that you’d have to have received a discharge in a Chapter 13 more than four years ago before you can file again.
