Are homesteaded houses protected in bankruptcy?

Our Professional Answer:

Under Florida law, Homestead Exemption that’s applied to your house, gives you relief from any creditors attempting to attach your house. What that means in bankruptcy is that your home is completely protected from your creditors. Now the exceptions here, just like under the Florida constitution would be that a mortgage that you granted against your house is not going to be discharged in the bankruptcy. However, all other debts will not attach to your house and your discharge and bankruptcy of those debts will still allow you to keep your house.
